CITY COUNCIL MEETING

January 10, 2011

5:15 P.M.

The city council met in adjourned session from the meeting of December 27, 2010 with the following present:  Mayor Jack E. Rowden; Councilmen Gary Baughman, Mike Eshbaugh, Greg Gill, Kim Harper, and Bob Mason.

Others present were Outside Utilities Supervisor Dean Banker, City Clerk Thomas G. Hicks, Municipal Judge Sherri Leonard, Chief of Police Courtney Leslie, City Inspector Tony Martin, Electric System Supervisor Gary Rowden, City Attorney Wayne R. Tate, and Ruthie Winget.

Mayor Jack E. Rowden presided.

The minutes of the meeting of December 27, 2010 were approved as mailed.

Each member of the governing body was provided a copy of Municipal Judge Sherri Leonard’s report for the month of December, showing 27 new cases brought before the court and $2,541.00 remitted to the city.

MUNICIPAL COURT

Municipal Judge Sherri Leonard notified the city council she has instituted the imposition of community service in lieu of the assessment of larger fines.  In 2010, 720 hours of community service were provided to non-profit organizations.  Leonard also reported $383.00 in outstanding fines have been collected so far by the collection agency.

INSPECTOR

City Inspector Tony Martin presented his monthly activities report.

WATER

The State of Kansas has approved the city’s applications for changes in the location of the place of use and use made of water on the water rights acquired by the county with the property for the new Pioneer Manor. 

Councilman Greg Gill arrived at 5:37 p.m.

WATER

Motion by Councilman Kim Harper, seconded by Councilman Greg Gill, to proceed with the negotiations on the purchase of the water rights from the county.  Motion carried.

Claims against the city were presented and audited.  Motion by Greg Gill, seconded by Bob Mason, that Appropriation Ordinance No. 1926 be passed.  Motion carried.

TRAFFIC

Motion by Kim Harper, seconded by Bob Mason, to set stop signs at the intersection of Fifth and Madison Streets to stop north and south traffic.  Motion carried.

Motion by Harper, seconded by Eshbaugh, that the meeting go into executive session in regard to personnel matters.  Motion carried.  Mayor Rowden called the meeting into executive session at 5:46 p.m. with the meeting to reconvene in open session at 5:56 p.m.

The meeting reconvened in open session at 5:59 p.m.

PERSONNEL

Motion by Harper, seconded by Mason, to set the salary of Chief of Police Courtney Leslie at $4,350.00 per month, effective January 10, 2011.  Motion carried.

PERSONNEL

Motion by Harper, seconded by Eshbaugh, that the outside utilities supervisor send a letter of reprimand to the head of the water department for failing to respond to water main breaks on December 31, 2010.  Motion carried.

Motion by Gill, seconded by Eshbaugh, that the meeting be adjourned to February 7, 2011 at 5:15 p.m.  Motion carried.

 

CITY COUNCIL MEETING

January 17, 2011

5:15 P.M.

The city council met in special session with the following present:  Mayor Jack E. Rowden; Councilmen Gary Baughman, Mike Eshbaugh, and Bob Mason.  Absent:  Councilmen Greg Gill and Kim Harper.

Others present were City Clerk Thomas G. Hicks, Chief of Police Courtney Leslie, City Attorney Wayne R. Tate, and Ruthie Winget. 

The purposes of the special meeting were to consider the acquisition of real estate, to finalize the purchase of water rights, and to discuss personnel matters.

Mayor Jack E. Rowden presided.

Motion by Councilman Bob Mason, seconded by Councilman Gary Baughman, that the meeting go into executive session in regard to the acquisition of real estate.  Motion carried.  Mayor Jack E. Rowden called the meeting into executive session at 5:16 p.m. with the meeting to reconvene in open session at 5:26 p.m.

The meeting reconvened in open session at 5:24 p.m.

Motion by Gary Baughman, seconded by Bob Mason, that the meeting go into executive session in regard to the purchase of additional water rights for the city.  Motion carried.  Mayor Rowden called the meeting into executive session at 5:45 p.m. with the meeting to reconvene in open session at 5:55 p.m.

The meeting reconvened in open session at 5:55 p.m.

WATER, FINANCE

Motion by Councilman Baughman, seconded by Councilman Eshbaugh, that Ordinance No. 773, AN ORDINANCE AUTHORIZING THE CITY OF HUGOTON, KANSAS TO MAKE WATER SYSTEM IMPROVEMENTS INCLUDING ACQUISITION OF WATER RIGHTS, AUTHORIZING THE CITY TO ISSUE ITS GENERAL OBLIGATION BONDS OR OTHER OBLIGATIONS IN THE PRINCIPAL AMOUNT OF $900,000 TO PAY COSTS OF SUCH IMPROVEMENTS, be passed.  Vote:  Councilman Baughman, yes; Councilman Eshbaugh, yes; and Councilman Mason, yes.  Motion carried.

WATER

Motion by Baughman, seconded by Eshbaugh, to authorize the mayor to execute a contract for the sale of water rights from Stevens County at a cost of $876,375.00.  Motion carried.

Motion by Baughman, seconded by Mason, that the meeting go into executive session in regard to personnel matters.  Motion carried.  Rowden called the meeting into executive session at 6:00 p.m. with the meeting to reconvene in open session at 6:15 p.m.

The meeting reconvened in open session at 6:15 p.m.

Motion by Eshbaugh, seconded by Baughman, that the meeting go into executive session in regard to personnel matters.  Motion carried.  Rowden called the meeting into executive session at 6:15 p.m.  with the meeting to reconvene in open session at 6:25 p.m.

The meeting reconvened in open session at 6:47 p.m.

Motion by Baughman, seconded by Eshbaugh, that the meeting be adjourned to February 7, 2011 at 5:15 p.m.  Motion carried.
